The HeLDEn Research Seminar Series comprises advanced lectures open to PhD students, university students, and postdoctoral researchers interested in the intersection of Law and Biomedical Sciences. On 15 May at 11:30, Professor Andrea Parziale will deliver a lecture entitled: How Much Is Enough? Full Compensation and Standardisation of Damages for Health-Related Injuries in the EU.
“When an accident occurs, the victim is entitled to recover damages from the injurer as compensation for their economic and non-economic losses. Non-economic losses include health-related injuries. Translating such injuries into monetary amounts can be quite discretionary and result in a damage lottery that can be unfair and inefficient. This seems to be a concern despite the increasing use of guidelines to help adjudicators quantify such damages. The seminar will explore how different legal systems across the EU tackle the quantification of damages to compensate health-related injuries and offer an outlet for discussion on how to reconcile equal treatment and personalisation in damage awards”.
